Terms of Service

By scheduling service, approving a quote, signing a work order, or submitting payment, the client (“Client”) agrees to these Terms of Service (“Terms”) from Boyer Elevator Services (“Company”). If a separate signed Contract is executed, that Contract governs the work described therein. Otherwise, these Terms apply.

1. Payment Terms

Full payment is due within 30 days of the invoice date unless otherwise stated in writing. Late payments may incur a finance charge of 1.5% per month (18% annually) or the maximum rate allowed by Texas law.

2. Payment Instructions
Clients must reference their invoice number on all payments. Accepted payment methods may include ACH, check, or credit card. Returned check fees and credit card processing fees may apply.

3. Disputes & Collections
Invoice disputes must be submitted in writing within 5 calendar days of the invoice date. Failure to do so constitutes full acceptance. Late or unpaid invoices may result in suspension of services, collections, and legal action.

4. Service Warranty
Services are warranted to be performed in a professional and workmanlike manner. Labor and parts are warranted for 30 days unless otherwise specified. Exclusions include:

  • Normal wear and tear
  • Misuse or unauthorized repair
  • Failures in third-party equipment

Remedies are limited to repair or replacement of defective service.

5. Cancellations & Rescheduling
Appointments must be canceled or rescheduled with at least 24 hours’ notice. Cancellations with less notice may incur a fee of 10% of the quoted amount.

6. Ownership of Materials & Lien Rights
All materials remain the Company’s property until paid in full. The Company retains the right to file a mechanic’s lien under Texas Property Code § 53.021 for unpaid services or materials.

7. Limitation of Liability
The Company is not responsible for delays or damages caused by events beyond its control, including weather, third-party delays, or Acts of God. The Company is not liable for indirect or consequential damages such as loss of elevator use or business interruption.

8. Indemnification
The Client agrees to indemnify and hold harmless the Company from any third-party claims resulting from misuse of services or breach of these Terms.

9. Governing Law & Venue
These Terms are governed by Texas law. Legal proceedings must be brought in Robertson County, Texas.

10. Digital Acceptance
Electronic acceptance of quotes, work orders, or invoices constitutes full agreement to these Terms.
